Can an ex-common law wife sue for a share of an inheritance left for you by your family member?
ByBlaque Veil asked:
I just recently inherited a substantual amount of $ from a family member. My ex-common law wife found out about it and threatened to sue me for a peice of it, stating that she is entitled to a share. We were seperated for a long while before I inherited, I say that she is not entitled. P.S. I have full custody of our child, I told her to leave me alone or I would sue her for child support–this was just a scare tactic on my behalf–the $ is for the raising of my child and a good amount has already been put in a savings account for my child.
We are from a common law state and leagally seperated.

It is my understanding that any inheritance from a family member does not have to be shared, even with your spouse.

i do not know what state you are in but very few have common law marriage. if you are from a common law state but have been separated, why are you not divorced? true, legal common law marriages need to be dissolved through divorce. i think she has no claim on an inheritance but if i were you i would be sure if she really is a common law wife to you or not, if not she has absolutely nothing to stand on.
